We therefore take all appropriate measures to protect your personal data processed by or through Nobi, in accordance with the applicable data protection legislation, including the EU General Data Protection Regulation (EU GDPR), the UK General Data Protection Regulation (UK GDPR) and privacy laws in the United States.

This privacy policy applies to the processing of your personal data by Nobi through the Nobi light, the Nobi platform (i.e. the application accessible on both computer, mobile device or through the API) and/or associated services. In this privacy policy, we explain what personal data we process of you, how we do it, why we do it, on what basis we do it, what rights you have and with whom we can share your data. We strive to inform you as transparently as possible.

We recommend to carefully read this privacy policy. You can consult this policy at any time under the 'Privacy policy' section on the Nobi platform or on https://eu.nobi.cloud/privacy.

This privacy policy does not cover the privacy policies, statements or terms and conditions of third parties, including those of our customers such as the care facility, nursing home, hospital or healthcare institution, or any other (care) facility of which you are a resident or care recipient (hereinafter referred to as the " Care Facility ") and which may be the data controller, if applicable. You may have to read our privacy policy together with the applicable privacy policy of the Care Facility.

Nobi may modify this privacy policy. It is therefore important that you consult it regularly. The most up-to-date version can always be found on https://eu.nobi.cloud/privacy. Any changes will be communicated via the support page of Nobi or on the website. This privacy policy was last updated on 1 September 2025.

This privacy policy is subject to Belgian law. Only the courts of (division(s) Antwerp have jurisdiction in the event of a dispute. If you reside in the United States, the laws of the United States, depending upon the state in which you live.

2. Who is responsible for processing your data?

2.1.

We are (Nobi), acting as ' data controller '. This means that we determine the purposes for, and the means by which, your personal data are processed. We ensure such processing is carried out lawfully and properly in relation to your use of the Nobi light, the Nobi platform and the associated services.

2.2.

With respect to the processing of personal data of the Nobi users within a Care Facility, we act as a data processor . This means we act solely on the instruction and on behalf of the Care Facility, being the data controller. We enter into a data processing agreement with the Care Facility, including clauses on the implementation of appropriate technical and organizational measures to protect the personal data of Nobi users for which the Care Facility is responsible. 4. What personal data do we process?

4.1.

We process your personal data in the context of the purchase, installation and use of the Nobi light, the Nobi platform and the associated services of Nobi. Personal data includes all information related to you and on the basis of which you can be identified or are identifiable as a natural person. Individual data sets, that, when combined together, can lead to your identification are also considered to be personal data.

4.2.

Below you can find a comprehensive overview for each category of data subjects (end user, other user or the Care Facility) of the data we process to be able to provide the services.

(i) The end user of the Nobi light (such as the care-dependent person, resident or otherwise):

  • Type of personal data:
    • When activating the Nobi light and setting up your profile on the Nobi platform:
      • Identification details, personal characteristics, and protected classification characteristics: name (first, last, call name), date of birth, gender, language and photograph.
      • Identification details of the trusted person or health care provider to whom the notification will be sent in case of a fall (name, phone number, email address);
      • Room number if the Care Facility actively manages multiple Nobi lights.
      • Whether the room in which the Nobi light is active is occupied by one or more individuals, in order to determine the appropriate person(s) to be notified in case of a fall, and to disable certain functionalities if necessary (e.g. Live view in/out of room or personalized morning greeting).
    • Regarding your use of the Nobi light for fall detection:
      • The address, i.e., the general geolocation, at which the Nobi light is or will be installed, together with an indication of whether the premises constitute a private residence, service flat, nursing home or another type of facility.
      • Inferences from your living habits, meaning that the Nobi light detects your presence or absence in the room (Live view), whether you are alone or accompanied in the room, whether you are in or out of bed, and whether you have fallen, solely for the purposes of operating and utilising the Nobi light.
      • Data concerning your specific circumstances or incidents (such as falls) that may be considered sensitive data, where such information is registered under your profile on the Nobi platform by your designated trusted contact or healthcare provider.
      • Visuals, e.g., sensory data, captured by the Nobi light, necessary for the functioning and optimal performance of the fall detection feature. The Nobi light performs local pattern recognition to determine whether a fall has occurred based on the captured visual. In the event that a fall is detected, the image is transferred to Nobi for review by a Nobi expert (human-in-the-loop) to confirm the accuracy of the light's analysis.
      • Any furniture, other people, photographs, devices such as a TV, sports equipment or other materials, goods, or commercial data located within the optical sensor's range of the Nobi light may appear in the captured visual.
      • As a Nobi end user, you determine the manner in which such images may be shared with the caregiver via the Nobi platform: not at all, in the form of a stick figure, or a full image. This allows you to opt for unrecognizable stick figures, enabling emergency responders to quickly assess the required assistance without transferring your full image to the Care Facility.
      • Sensory data, specifically, audio recordings made after the detection of a fall. After each recognised fall, the Nobi light will prompt you to verbally confirm whether or not you have fallen;
      • Special categories of data, e.g., sensitive data and inferences, namely health data of you as an end user, to the extent that this is relevant for the use of the light:
        • Data related to your physical health such as your fall history.
        • Data related to your mental health: fear of falling, dementia (only where necessary for monitoring in the context of fall prevention, sleep pattern or other health related matters).
        • Data on your sleep pattern (limited to in or out of bed).

(ii) Other users of the Nobi platform such as the trusted contact, caregiver or healthcare provider:

  • Type of personal data:
    • Your login credentials (sensitive data) to gain access to the Nobi platform (such as user ID and password).
    • Contact information and identifiers when setting up the Nobi platform settings, such as your name and email address.
    • Internet or network data, specifically:
      • A limited part of the IP address of your device on which the Nobi platform is installed.
      • Essential cookies that are required for purely technical reasons in order for the Nobi platform to function correctly.
    • Your telephone number, where you have indicated a preference to receive a phone call when a notification is sent to the Nobi platform.
    • If you use the Nobi platform via the Nobi application on your mobile device, you can choose to share your (geo)location data, this only for the purpose of connecting any Bluetooth devices and only if necessary for the functionalities and optimal use of the Nobi light, the Nobi platform and associated services. The data collected for this purpose is not used to infer any characteristics.

(iii) (Representatives of) the Care Facility:

  • Type of personal data:
    • Identification details, where you are a natural person such as a healthcare provider, appointee or employee of the Care Facility, including name, address and email address.
    • Your telephone number, where you have indicated a preference to receive a phone call when a notification is sent to the Nobi platform.
    • Identification details where the Care Facility engages Nobi in the form of a legal entity, including name, registered office, address(es), company registration number and VAT number of the company or organization, as well as names, positions and email addresses of the contact persons, appointees or employees.
    • Financial and commercial information of the Care Facility, including account number and other payment-related information.

5. For what purposes do we process your personal data?

5.1.

Nobi processes your data in the context of your use of the Nobi light, the Nobi platform or the Nobi services for the following purposes:

  1. The Nobi light is intended for the care of vulnerable adults or individuals in need of assistance, to help them to age with peace of mind and to continue living in the setting of their choice. The Nobi light is designed to support people in need of care, whether living independently or residing in a Care Facility, and in particular in the context of fall prevention. For example, the Nobi light may automatically switch on a soft light when it detects that you have risen from bed, thereby reducing the risk of falling in the dark.
  2. The Nobi light assists the caregivers of the Care Facility in providing care for the residents. Nobi does this by detecting falls and notifying caregivers or family members through a notification on the Nobi platform or, where applicable, by means of a telephone call, thereby enabling the person in need of care to receive assistance as quickly as possible. The Nobi light uses its locally embedded artificial intelligence system with pattern recognition technology to assess whether a fall may have occurred. Once the light's detection is verified by a Nobi expert (human-in-the-loop), a notification is triggered and sent to the Nobi platform. The human-in-the-loop approach minimizes false alarms and ensures that only genuine incidents trigger notifications.

The care of the Nobi user by means of fall prevention and detection is the primary purpose of processing your personal data . More information can be found at https://www.nobi.life/.

  • Furthermore, Nobi can process your identification / contact details to contact you, process the questions or complaints you may have and provide you with necessary information about our Nobi light, the Nobi platform, our services, our website or other information related to our activities or services.
  1. We also process your personal data to enable you to access the Nobi platform, to create accounts and profiles for you, to provide our (platform) services to you, and to facilitate communication between the Nobi user(s), family members, trusted contacts and/or caregivers. For example, through the Nobi Platform, we may send you status and update messages, as well as emails related to the Nobi light and the Nobi Platform, including confirmations, welcome emails, push notifications and other communications related to your use of the Nobi light and the Nobi Platform.
  2. We also process your data to enhance the performance of the AI system embedded in the Nobi light, with the aim of improving the accuracy, reliability and safety of fall detection. This helps the detection by the light become more accurate in detecting falls, while also contributing to the overall reliability and safety of the Nobi services. We only use anonymized data for this purpose. This means that the data used for training can no longer be linked to an individual.
  3. Your personal data (such as financial data) as a Nobi user or Care Facility is processed in the context of our back office services , customer service/help desk, management of our customer files and users, payments, administration, invoicing, solvency follow-up and for our accounting purposes.
  • Finally, your data (only contact details such as name and email address) can be used for direct marketing purposes. This entails sending information about Nobi, our products and services or other information that might be interesting or useful to you via our newsletter, emails or other means.

6. On what legal grounds do we process your personal data?

6.1.

To be able to process your personal data, we must rely on a valid legal basis under the data protection legislation. This legal basis depends on the specific relationship we have with you and the purposes of the data processing, as outlined in this privacy policy.

6.2.

If you enter into a contract directly with Nobi, for example, as a Nobi end user, the legal basis for the processing of your personal data is typically the preparation or performance of that contract.

6.3.

If you do not have a direct contractual relationship with Nobi, e.g. when you are a family member, trusted contact, or caregiver of a Nobi end user, then Nobi relies on its legitimate interests as a legal basis for processing your personal data.

These interests relate to the activities that are necessary for the functioning, organisation, governance and development of the Nobi services in line with the needs of end users and Care Facilities. This includes ensuring that the Nobi system functions as intended, as well as further development of the technology, such as training the AI system(s) embedded in the Nobi light to recognize falls accurately through pattern recognition.

Nobi can also process data for generating aggregated statistics and conducting market analysis, to optimize the Nobi light and platform and the Nobi services, evaluating and improving internal workflows and business processes, collaborating with Care Facilities, facilitating day-to-day operations, engaging in direct marketing where permitted by law, preventing misuse, fraud or other unlawful activities, managing risks and ensuring business continuity, protecting our infrastructure, employees, users and stakeholders, safeguarding network and information security, providing employee training and supervision, monitoring and enforcing internal policies and procedures and managing or defending legal claims where Nobi is involved.

In such cases Nobi carefully assesses whether the processing is necessary and proportionate, and conducts a balancing test to ensure that its legitimate interests do not override the fundamental rights and freedoms of the data subjects involved. Where appropriate, additional measures (such as pseudonymization) are implemented to further minimize the impact on your privacy. 6.4.

In certain situations, we will only process your personal data based on your informed and explicit consent.

This is the case when we process health data, visuals or other sensitive data. We will ask for your explicit consent to allow the Nobi light to capture visual data to detect a fall (which means using its integrated AI technology, followed by a verification by a Nobi expert). We will also ask for your consent to display the captured visual, either as a full image, as a stick figure or not at all, depending on your preferences, on the Nobi platform for the designated caregiver to take action. The decision to share a visual with the caregiver or the trusted individual rests entirely with you.

Your consent will be obtained either directly through Nobi or, where applicable, via the Care Facility using a consent form that explains the purposes and scope of the processing in detail. Your consent is free and can be withdrawn at any time.

If Nobi acts solely as a data processor on behalf of a Care Facility, that Care Facility is responsible for determining the legal basis for the processing of your personal data and, where required, for obtaining your consent, unless it can rely on an alternative legal basis under applicable data protection legislation.

We also process your identification data based on consent for direct marketing to prospects (not being customers).

6.5.

In certain cases, Nobi processes your personal data to comply with legal obligations . This may include retaining or disclosing data when required by law, or responding to lawful requests from supervisory authorities.

7. Where do we receive your data from?

7.1.

Nobi can receive your data directly from you, e.g. when you purchase or install the Nobi light and/or through your registration on the Nobi platform, when you contact Nobi (by telephone, in writing or via the Nobi platform) or when you provide it to us as a Care Facility (for example through the Nobi platform).

7.2.

Other data relating to you are automatically generated and processed through the Nobi light and Nobi services during use, such as information indicating whether you are in or out of bed, in or out of the room, or whether a fall has occurred. The specific data collected depend on the functionalities of the Nobi light that you have activated and are collected only when the Nobi light detects a relevant event, processing your data, or that of another person, in that context for the purposes described above. Certain data are only processed in the event of a fall or where the Live view feature is enabled, and only to the extent that you, as a Nobi (end) user, have accepted or configured such processing through the privacy settings in the Nobi platform.

7.3.

Nobi can also receive certain data indirectly, e.g. from your trusted contact or representative, or your caregiver, healthcare provider or Care Facility that enters your data on the Nobi platform (only for the purposes described above).

8. With whom will your data be shared?

8.1.

Your personal data are shared internally within Nobi, solely with our employees who require such access for the performance of their tasks. Nobi applies a strict access control policy, ensuring that only those who need your data, for example, to provide support, ensure technical follow-up, or comply with legal obligations, are granted access. This internal access is based on the 'need-to-know' principle and is regularly reviewed and monitored. These employees are obliged to maintain strict confidentiality with regard to your personal data.

8.2.

Some of your data may also be processed by our partners, service providers, subcontractors or suppliers in connection with the use of the Nobi light, the Nobi platform and our services. This includes, for example, our hosting provider, technical support suppliers, communication provider (to send the notification by message/SMS, to notify the fall by telephone or to contact the emergency services directly), our Nobi expert partners (who verify the fall detected by the light before the notification is sent to the Nobi platform (human-in-the-loop)), our software suppliers, companies that provide payment services or other services to Nobi.

8.3.

If you are an end user of the Nobi light residing at home, your data can be shared with your designated family member, trusted contact or representative. Such person will also have the ability to manage your data via the Nobi platform. If you are an end user residing in a Care Facility, your data will also be shared with the Care Facility and with your designated caregiver or employee. They will have access to your profile on the Nobi platform including the personal data referred to in article 4.2 (i) above.

8.4.

Other companies may also process your data as part of our operational business, such as, for example, our accountants, auditors, company auditors, insurance brokers, insurers, legal advisors, attorneys or other service providers to the extent necessary in the context of their assignment(s) or assistance.

8.5.

We may be required, by law or in response to a request or order by a supervisory authority, court or government agency, to provide your personal data to them or to a third party.

8.6.

Partners, service providers or suppliers of Nobi only receive your personal data if necessary for delivering their services to Nobi in connection with the Nobi light and/or the Nobi platform. Nobi enters into a data processing agreement with its (sub)processors to ensure that personal data is processed securely and in compliance with applicable data protection legislation. These data processing agreements enable Nobi to provide the assurance to the Care Facility that the selected (sub)processors comply with the applicable data protection legislation and required standards (such data processing agreements include a list of Nobi's (sub)processors).

9. How do we handle (international) data transfers?

9.1.

Where the end user is located within the EEA/EU, Nobi always strives to process your personal data within the EEA/EU. The processing activities of Nobi's services related to fall prevention and detection, including those performed by the Nobi light and the Nobi platform, are hosted on servers located within the EEA/EU.

9.2.

If Nobi contracts with service providers located outside the EEA/EU, it ensures that the data is hosted on servers within the EEA/EU. Additionally Nobi implements the following appropriate safeguards:

  • An adequacy decision by the European Commission confirming that the country outside of the EEA/EU to which your personal data are transferred ensures an adequate level of protection equivalent to that provided under the GDPR or applicable data protection legislation (such as the Unites States under the EU-US Data Privacy Framework and the United Kingdom).
  • Entering into the applicable Standard Contractual Clauses with the recipient of the personal data outside the EEA/EU.

9.3.

When your personal data is transferred outside the EEA/EU, Nobi implements additional appropriate technical and organizational measures such as pseudonymisation or anonymisation of your data. The type of measures taken depends on what is technically feasible and sufficiently effective.

9.4.

If the Care Facility is located in the United States, all data relating to that Care Facility and its (end) users will be stored exclusively on servers located within the United States.

10. How long do we keep your data?

10.1.

Nobi collects and processes personal data only for the purposes described in article 5 above. Nobi shall not process or retain your data any longer than necessary for such purposes, unless stipulated otherwise by applicable legislation. Specific retention periods may apply to certain data, but the general principle applies that we do not retain your data longer than necessary for the purposes.

10.2.

Your data as a Nobi user will generally not be processed any longer than the duration of your use of the Nobi light, Nobi platform and services or the duration of the agreement with Nobi. We may retain certain data up to 10 years after the end of the contract to the extent necessary to defend our rights or interests in the context of a dispute.

10.3.

The visuals captured by the Nobi light are locally stored in the Nobi light or on Nobi's systems for a maximum of 30 seconds. Only if a fall is detected by the Nobi light, the visual is sent to Nobi and a human verification of the fall is done by the Nobi expert. If the expert reaffirms the fall, a notification is sent to the Nobi platform, with or without the accompanying image, depending on your chosen privacy settings. The Nobi expert's access to the image is strictly time-limited and automatically revoked after 120 seconds, after which the expert no longer has any access to such data.

10.4.

If you choose to include the visual (full image or stick figure) with the notification in the event of a fall, it will be visible on the Nobi platform for up to 14 days after the fall. Audio recordings or auditory confirmations of the fall are retained by Nobi until the end user no longer wishes to use the Nobi light and services and the profile is deleted.

10.5.

If you choose to enable the Live view feature, the Nobi platform will provide a stick figure visual of the resident whenever the resident is in the room and not in the bed. All visuals are converted locally in the Nobi light to stick figure images. In relation to the Live view feature, full images are never transferred to Nobi. Once converted locally in the light, these visuals are sent to the Nobi platform where they will be deleted after 14 days. The Live View feature will never provide visuals on the Nobi platform once the Nobi light detects that the person is in bed. In this case, you will only see the notification "resident in bed". The Live view feature is not available for the Nobita light, as it does not support this functionality.

10.6.

Nobi shall not retain any images containing personal data for more than 14 days. Where data is retained for purposes such as algorithm training or statistical analysis to assess efficiency improvements in a care facility, such data shall be fully anonymised and rendered permanently non-identifiable.

10.7.

Personal data processed by Nobi in the context of direct marketing will be kept for a maximum of 2 years after the last contact with the customer or prospect.

10.8.

After the expiration of any retention periods, your personal data will be deleted, pseudonymized or anonymized, unless applicable legislation requires longer storage.

10.9.

When processing personal data on behalf of the Care Facility (where Nobi qualifies as a data processor), the Care Facility is responsible for the duration of the data processing as well as the return and/or erasure of personal data, in accordance with the applicable data processing agreements between Nobi and the Care Facility.

11. What are your rights?

11.1.

You have the right to information about the processing of your data via the Nobi light, Nobi platform and services. This is communicated to you via this privacy policy. If necessary you can request more information from Nobi or from your family members, trusted contacts and/or healthcare providers at any time.

11.2.

You also have the right to request:

  • Access to your data.

    You may obtain one copy of the requested information free of charge. If you request additional copies, we may charge you a reasonable fee for administrative costs.

  • Rectification of your data (if necessary);
  • Erasure of your personal data if:
    • the processing of that data is no longer necessary for the purpose(s) for which it was processed by us;
    • you have withdrawn a previously given consent;
    • you object to processing by us;
    • the personal data would have been unlawfully processed by us;
    • this is necessary to comply with a legal obligation; or
    • the personal data would have been processed in connection with an offer of online services to children (which is not applicable).
  • Restriction of the processing affecting you if:
    • challenge the accuracy of the data in our possession;
    • the processing is unlawful and you oppose the erasure of the personal data and request instead the restriction of its use;
    • we no longer need this data while you still need this data for the establishment, exercise or vindication of a legal claim; or
    • pending an answer to the question of whether Nobi's legitimate interests outweigh yours or your (privacy) rights, if you have objected to processing based on our legitimate interests.
  • You have the right to object to the processing of your data. You can object to the processing of your data for direct marketing at any time and free of charge. This can be done simply by letting us know at privacy@nobi.life or by unsubscribing by email or otherwise. You will then no longer receive newsletters from us.

11.3.

You have the right to transfer your data (to another controller), in a structured, commonly used and machine-readable format, if the processing is based on consent and is carried out by automated means.

11.4.

If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time.

11.5.

You have the right to file a complaint with the competent supervisory authorities. For Belgium this is the Data Protection Authority (Drukpersstraat 35, 1000 Brussels - T: +32(0)2 274 48 00 - E: contact@apd-gba.be). In the event of a complaint, you can also contact Nobi at any time ( privacy@nobi.life) or your Care Facility.

11.6.

The exercise of your rights, as set out above, is always subject to the requirements and conditions under applicable data protection legislation (such as the EU and UK GDPR).

11.7.

To exercise your rights, you can simply send a request to Nobi at privacy@nobi.life or call the Nobi Customer Service phone number (+32 3 808 60 78). When doing so, you must identify yourself. If we have reasons to doubt your identity, we may ask you for additional information necessary to verify and confirm your identity to the extent that this is necessary and proportionate.

12. UK Privacy Notice (supplementary)

12.1.

This privacy notice section supplements our overarching privacy policy and specifically applies to individuals accessing and using the Nobi services and residing in the UK. Where not governed by this section, the provisions of the (general) privacy policy of Nobi shall continue to apply.

12.2.

To enable us to offer services that process personal data in the UK Nobi has a UK representative (8foldGovernance), registered with the Information Commissioner's Office (ICO) under number ZB792945.

12.3.

What about your rights as a UK resident? Your rights as an individual residing in the UK are the same as set forth above under section 11 of the (general) privacy policy (as a EU data subject). For exercising your rights you can contact Nobi on privacy@nobi.life. For identification of UK residents without an ID card Nobi accepts an electronic copy of a passport or driving licence.

  • Your right of access - You have the right to ask us for copies of your personal information.
  • Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
  • Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.
  • Your right to object to processing - You have the right to object to the processing of your personal information in certain circumstances.
  • Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

12.4.

As Nobi is EU based (Belgium), personal data may be transferred outside of the UK when necessary. When personal data is transferred outside of the UK, appropriate technical and organisational safeguards are in place and in compliance with applicable data protection legislation (including the UK GDPR).

12.5.

We strive to meet the highest standards when processing personal data. Any complaints we may receive we take very seriously. We encourage you to inform us if they think that any processing of personal data would be unfair, misleading or inappropriate.

You can again do this by contacting us via privacy@nobi.life and you may also contact our Data Protection Officer (DPO) in the EU or our UK Representative.

You have the right to file a complaint with the Information Commissioner's Office (ICO) for any issues on data processing in the UK. Please see the ICO's website for more information: www.ico.org.uk.

13. U.S. Privacy Notice (supplementary)

13.1.

This privacy notice section supplements our overarching privacy policy and specifically applies to individuals accessing and using the Nobi services and residing in a U.S. state with applicable privacy laws. Where not governed by this section, the provisions of the (general) privacy policy of Nobi shall continue to apply.

13.2.

We may also verify the identity of your designated agent.
